Challenging the MSA

This is a BIG deal folks and a must read!

The Competitive Enterprise is set to challenge the constitutionality of the $249 billion Master Settlement! When I first read about this a few weeks back I thought that I was dreaming. I was not. Apparently, there are some folks out there who care about the Constitution and the fair treatment of smokers. I know, it's hard to believe, but it's true.

This case, if heard by the Supreme Court has the potential to put a halt to the 14 year collusion between the states attorneys general and big tobacco. The cruel and un-constitutional act of extorting smokers via de facto taxation without representation may indeed be approaching the winter of its prosperity. Kudos to the Competitive Enterprise Institute for taking up this cause. It is clear that everyone has benefited in this deal except for the folks paying for it: we,the smokers. The days of trial lawyers and states getting rich off of the very people that they persecute are hopefully coming to an end.

In aggregate, the petition for a Writ Of Certiorari, along with all of the accompanying links/articles provided in the link(s)below should serve to disarm even the most ardent anti-smoker when it comes to the accusation(s) that smokers cost society. In fact, according to one article, what we smokers have been subjected to is in fact a "reverse Robin Hood" phenomenon where the poorest of the poor end up funding the richest of the rich. It is time for this to stop. It is time to smokers to get the healthcare that they/we have paid for and continue to pay for.

Oh, if only there is any justice left in this world...one can hope.

I know that I've got my reading work cut out for me for awhile.

2nd hand radiation anyone? I wonder how long it's going to take before talking or texting on a cell phone in public is banned. If studies with even a low relative risk begin to accumulate, politicians will have to ban it in order to remain consistent with all of the other activities that they so love to ban. This is the tyrant that wanted to draft an ordinance to arrest smokers for smoking outside on a sidewalk. He wanted to make it a misdemeanor offense, punishable by up to 6 months in JAIL. This, coming at a time of an extreme budgetary crisis where libraries and police officers are being furloughed, prisons are overcrowded, and small businesses are struggling with high overhead costs and over-regulation. Councilman Parks has demonstrated to us that he favors tyrannical behavior over common sense and the American values of individual freedoms and autonomy. Anyone who is this extreme (and inept)in their views is neither a fiscal conservative nor a bleeding heart liberal. Vote him out!

Stimulus funds aim to help kick cigarettes - Washington Times

But opponents called it a “grotesque” use of taxpayer dollars that has little to do with getting the economy back on track — the stated goal of the stimulus.


That is an UNDERSTATEMENT. Oh, how I've been wanting to comment on how stimulus funds are being used for anti-smoking campaigns, but I just have not had the time to do so. Thank you Washington Times for shining light on this egregious waste of our tax dollars. If you're wondering where your tax dollars (aka stimulus funds) are going while states are cutting funds for elderly home care and police, here is one "shocking" example. Ugh, words cannot describe how I feel about this. In reading this article in the Washington Times today, I am brought back to a couple of articles from last year (here in Los Angeles). There are empty storefronts all over Los Angeles and the un-employment rate is one of the highest in the country! When I first read about stimulus funds being used for anti-smoking some months back, I thought that it must be some kind of joke. It's no joke. So, what "programs" are OUR stimulus funds in L.A. county being spent on? You guessed it: It's being used to bully the very citizens that are paying for it in the first place:

Los Angeles County won two stimulus grants Friday worth $32 million to fight obesity and smoking, the largest sum ever dedicated to these public health problems, officials said.

"This is really a win for the county," said Dr. Jonathan Fielding, director of the county Department of Public Health. "We will be able to do a variety of things to try and change the environment."


Really? Change the environment? How about we do something about the un-employment rate? Now that's something that would reduce a LOT of stress and make us all a lot healthier, something that these tyrannical, Orwellian turds obviously know nothing about.

So, my dear non-smoking friends whose spouses and friends are losing their jobs at unprecedented rates here in the lovely "Golden State" (and elsewhere around the country), just realize that the next time you see a "media campaign" that is designed specifically to bully your smoking friends like me, know that YOU too are paying for it. Oh, now this is truly an interesting read about Los Angeles City Councilman Bernard Parks, the man who wanted (he failed) to making smoking on a sidewalk a misdemeanor offense (ie., you could be arrested and get actual jailtime), um for the "safety" of the public.

"The more the public learns about the hypocrisy, vindictiveness, and selfishness of Bernard Parks, the likelier they are to echo the sentiments of LAPD officers who years ago rejected him as their leader."


Oh, do I ever agree with that statement.

This is just one more example of smoke bans & the un-intended consequences that so often accompany the neo-healthist policies of do-gooderism. Thanks to the anti-smoking crusade a 23 year old woman is dead. Even though this is an event that took place in the not too distant past (it occurred last Sept.), it is important that this story gets passed around. If she would have been INSIDE a smoking allowed bar she would not have been OUTSIDE with the impending danger; real danger I might add, something many anti-smokers know nothing about as they rest easy in their well to do abodes that so often have gated communities. The rest of us have to live outside the bubble, in the real world where many of us live in big cities where it is often downright dangerous to be standing outside (often alone) at night.

Guns pulled on man with cigarette

"I just had a smoke in my hand and they were pointing that (gun beam) at me -- pointing it right at my chest here and telling me to put my smoke down. And I was telling them to hold on for a second -- I had two more drags," Kennedy said Saturday of the incident, which was caught on video by a QMI Agency photographer.

"And they started screaming at me, ‘Put the f---ing cigarette down!' or something -- really loud, man."


Ok, now this has to be a parody right? Satire? Um, no. Ok, but surely they must have a valid reason for threatening a man's life; it wasn't just about the cigarette, right?

He was not arrested or charged with anything. Why? Because he was doing nothing wrong in the first place. They did apparently charge some "other" 17 year old boy (no mention of the boy's identity) with possession of a concealed weapon: a pellet gun that was found "somewhere" in the area. A pellet gun? Isn't it hard to kill a rodent with one of those things? Was the "other" boy actually holding and pointing the thing at anyone, because that would change the entire story. To be fair, police work is and can be extremely dangerous work. I get that. If someone is actually holding a weapon in the presence of a police officer, than it is clear that the officers must defend themselves, or the lives of anyone else in the area. This is NOT what took place and the man with the cigarette, was well, just holding a god damn cigarette. It is an understatement to say that they were "over-reacting".

What is clear is that the man with the cigarette was minding his own business and almost lost his life as a result. The young woman in the first article was not so lucky.

Stop the madness.

It's becoming increasingly hard not to believe that our politicians indeed have a vested interest in keeping the act of smoking as dangerous as possible. I mean, how else could they defend the over-taxation of smokers? I am becoming quite speechless as everyday I read about tobacco control's authoritarian crusade against tobacco or anything that looks like it. All I can say is that I'm glad that I don't live in NYC. I may reside in anti-tobacco California, but at least I can escape to the mountains, or to the desert...or to Vegas. Where do you escape to in NYC?

Vaporizer for Tobacco!

I have been wondering for the longest time why in the hell someone hasn't come up with this idea sooner. Of course, there's the Eclipse, one of the first real vapor, um, e-cigs; the only difference between the former and the latter is the fact that Eclipse uses real tobacco and the e-cig does not. Only 4% of the tobacco from Eclipse burns, the other 96% is vapor. There's no 2nd hand smoke, never was and never will be. I still believe that it is a shame that to this very day no one (ok, hardly anyone) has even heard of it, thanks to the ban on free speech and the resulting lack of communication between producers of tobacco and their customers. For those of us who love the taste of real tobacco, rather than e-juice, the Eclipse should have been a godsend in light of all of the draconian smoking bans that have popped up across the western world.

There should be no reason why you can't smoke (um, vape sorry) an Eclipse wherever there is a smoking ban, um because there is virtually no combustion or sidestream smoke. Ah, but just the "sight" of "seeing" someone use a lighter to get the heating process started with the Eclipse is enough to send the anti-tobacco Taliban after you. Never mind the fact that there is no health risk to anyone around you, it looks like smoking, and we can't have that now can we?

Well, there is a new product in town that might be of interest to many smokers and vapers alike. It is butane powered; therefore, there is no more need for an external lighter. Now you can vape real tobacco without having to worry about some burly bouncer assaulting you while you're trying to enjoy yourself at a club, bar or restaurant just because he/she sees you using a butane lighter.

I found this video on Youtube that showcases this novel invention.

There are prepackaged tobacco and herbal "pods" that are to be used in conjunction with the Ploom. It would be ultra coolio if I could use my own tobacco, but never the less, I am excited to try it out with the pre-packaged pods. I did observe someone on another Youtube video refilling one of the pods with his own tobacco, though that is not the intended use that is recommended by the manufacturer. I too would like to use the ryo tobacco of my own choosing; however, even if that is not possible in this case, I am nevertheless quite excited about this new product, merely for the fact that the idea has been set into motion.

I am off to order one now! I will write a review of my personal experience with the Ploom after mine arrives in the mail.
